TERMS OF USE
Welcome to AdorableWife.com, the service created for adults with the purpose of online dating and operated by E-date Service dating agency located in Novosibirsk (Russia). You must read and agree to these terms and conditions before you use our services. The present Agreement stipulates your obligations when you visit AdorableWife.com and when services are rendered to you as a result of your registration. E-date Service reserves the right to change the terms of use unilaterally. Such changes take effect after their publication on AdorableWife.com.
1. Elegibility:
You must be 18 years old or over to be registered as a member and use this site. By using and/or viewing this site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of its terms and conditions and that you are at least 18-years old. (21-years old in AL, MS, NE, WY, and any other location where 18 is not the age of majority).
2. Terms:
This Agreement will remain in full force and effect while you use AdorableWife.com as a member. The fees of the paid membership usage of AdorableWife.com are provided to you upon registration and may change. You will be notified by electronic message if such changes take place. You may terminate your membership at any time, for any reason upon receipt by E-date Service staff of your written or email notice of termination. E-date service reserves the right to terminate your access to the site for any reason. E-date Service can terminate your paid membership upon sending you a short notice to the email address you provide in your application for membership or to any other email address you may later provide us with. If E-date Service terminates your membership at AdorableWife.com for the reason that you have breached this Agreement, you will not be entitled to any refund of any unused membership fees. Even after the cancellation of the Agreement, cancellation of your membership and the termination of services rendered, certain parts of the present Agreement will remain in force, including sectors 4, 5, 7, 10-15 of this agreement.
3. Non-Commercial Use by Unpaid Members/Viewers:
The AdorableWife.com site is supposed to be for the personal use of individual members and viewers only and may not be used in connection with any commercial endeavors. Organizations, companies or associations may not become members of AdorableWife.com and should not use the AdorableWife.com service or site for any purpose. Any illegal and/or non-authorized use of AdorableWife.com , such as gathering member names and/or e-mail addresses with the use of software for the purpose of distributing unsolicited bulk commercial email (spam), computer viruses, and also illegal linking to the site, opening any of Site pages in the frame of another site, will be investigated, and the measures of civil, administrative and criminal law will be taken.
4. Property Rights of Content:
E-date Service fully owns AdorableWife.com site and the services rendered. The site contains the copyrighted material, trademarks, and other proprietary information of E-date Service company or the third parties. You have no right to copy, change, publish, transfer, distribute, reproduce or sell the information contained at AdorableWife.com except for the information which is considered to be well-known or public.
5. Contents of the Site:
A) You acknowledge and agree, that E-date Service can look through and delete any information, messages, photos and member profiles, which in the sole judgment of E-date Service violate the terms of the present Agreement, and also offensive or illegal materials which may infringe on the rights of other members, harm or threaten the safety of other visitors of AdorableWife.com or its members.
B) You are fully responsible for the content that you publish or display on AdorableWife.com or transmit to other AdorableWife.com members.
C) By publishing your information at any section of AdorableWife.com , you automatically transfer E-date Service and its members irrevocable, constant and non-exclusive right, to use, copy, reproduce, publish and distribute this information with an opportunity to transfer to third parties, free-of-charge and without territorial restrictions, to use it for creation of derivative works or together with other materials and information, and guarantee, that you have the right to use materials transmitted to E-date Service rights. If you provide E-date Service with your email address via a registration process or publish it on AdorableWife.com thereby authorize E-date Service and its affiliates and any entities that E-date Service deals with, the right to use and/or sell your valid email address for any marketing programs or communications with you.
D) The following section lists the content that is forbidden for publishing at AdorableWife.com. as well as for sending it to other members of AdorableWife.com . E-date Service will investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the service and terminating the membership of such violators. Materials, publication of which is forbidden include: offensive materials including racism promotion, bigotry, hatred or physical harm of any kind against any group or individual; materials, infringing the rights of third parties or supporting such infringement; any sort of junk mail like "letters of happiness", "chain letters", etc. or unsolicited commercial advertising mail (spam); materials, containing obviously false or misleading information, recommending illegal actions or offensive, menacing, obscene, discrediting or humiliating behavior, and also assisting such actions or behavior; mail promoting an illegal or unauthorized copy of another person's copyrighted work, such as providing pirate computer programs or links to them, materials, displaying contents of any websites or their separate pages, access to which is limited or requires a password, containing references, for bypassing such restrictions, and also displaying hidden pages and images with no references from other publicly accessible sites; materials displaying pornographic or sexually explicit content of any kind; materials of erotic or violent character with regards to people under the age of 18; materials containing information, describing technology or instructions for the creation or purchase of weapons of restricted circulation or which are forbidden, creation of computer viruses, infringement of personal privacy rights, or fulfillment of other illegal actions; passwords or personal identifying information for commercial or unlawful purposes from other users; mail engaging in commercial activities and/or sales without our prior written consent including offers to participate in prize draws, totalizator, advertising campaigns, financial pyramids, gambling.
E) You must use AdorableWife.com and its services in accordance with all applicable laws and resolutions.
F) You have no permission to include any telephone numbers, post addresses, web-pages Internet addresses and e-mail addresses in the fields of your profile, which are not intended for entering such information.
G) You agree that you will not use any device or software to bypass or to interfere with the proper working of AdorableWife.com . You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. Much of the information on our site is updated on a real time basis and is proprietary or is licensed to E-date Service by our users or third parties.
H) You may not advertise, buy or sell any goods, works or services by using AdorableWife.com . You have no right to send any junk email to other AdorableWife.com members. Although E-date Service cannot monitor the conduct of its members outside AdorableWife.com , it is also considered to be a violation of this Agreement to use any information obtained from the service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any member without their prior explicit consent. In order to protect members from such actions, E-date Service reserves the right to restrict the number of messages which one member can send to other members per day, up to such a number, which E-date Service considers reasonable at its own discretion.
6. Copyright Policy:
You may not post, distribute, or reproduce in any way any material protected by copyrights on AdorableWife.com in any form without the prior written consent of the owner. If you believe, that publication of any materials at AdorableWife.com infringes your copyrights, provide our copyright agent with the following information: electronic or physical signature of the person, who is acting on behalf of the owner of the copyright interest; the description of the material or publication which you believe to infringe your copyright law, location at AdorableWife.com, your telephone, postal address and e-mail address, your written statement, that the publication of the given material is not authorized by the copyright owner and was done without the consent of the copyright owner of the material, his/her legal representative and in the absence of other legal grounds, also a written statement, that the information given by you is precise and that you are the copyrights owner to the published material or act on his/her behalf. In case the submitted information is not accurate, you can be accused of deliberate deception and sanctions established by law can be applied to you.
7. Members' Disputes:
E-date Service does not control the information provided by other members. You may find other members' information to be offensive, harmful or deceptive. Please be cautious and use your common sense when using our site and services. You are solely responsible for your interactions with other AdorableWife.com members. E-date Service reserves the right, but does not take upon itself the unconditional obligation to represent itself as an intermediary in the settlement of disagreements between registered members of AdorableWife.com.
8. Privacy:
Use of AdorableWife.com and its service is governed by our Privacy Policy, which may change from time to time upon sending the electronic notice to you.
9. Disclaimer:
E-date Service including all its employees and agents is not responsible for any incorrect or not valid content published on AdorableWife.com or in connection with AdorableWife.com service, whether caused by other members or by any equipment or programming associated with the service, nor for the conduct of any member of AdorableWife.com both online or offline. E-date Service bears no responsibility for actions of visitors or members of AdorableWife.com when they are using the site directly or when services are rendered to them, or at any other time. E-date Service does not bear responsibility for errors, omissions, operational breaks, loss or distortion of information, operational delays or delays in the transfer of information, communication line failures, theft or destruction of information, and also for illegal access to a communication facility and information of visitors or members. All materials, data and information published at AdorableWife.com as well as the services rendered are provided "AS-IS" and E-date Service does not guarantee the suitability of provided materials, data, information and services to certain purposes or the non-infringement of someone's rights. E-date Service does not guarantee any specific results after visiting AdorableWife.com and using its services.
10. Limitation on Liability:
Except in jurisdictions where such provisions are restricted (and in that event liability is disclaimed to the fullest extent permitted by law), in no event will E-date Service be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of AdorableWife.com or its service, even E-date Service has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, E-date Service's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to AdorableWife.com for the service during the term of membership.
11. Arbitration of Disputes:
You agree that Russian Federation law (regardless of conflicts of law principles) shall govern this Agreement, and that any dispute arising out of or relating to this Agreement shall be subject to the federal courts in Russian Federation.
12. Indemnity:
By accepting the conditions of the present Agreement, you exempt E-date Service and also its subsidiaries and affiliated companies, administrative board, employees, agents and partners from payment of any compensation to third parties, including payments of lawyer's remunerations and any court expenses if the damage was caused to them due to your infringement of the conditions of the present Agreement when using AdorableWife.com and rendering its services, rejecting acknowledgements and guarantees, which you provided in connection with its conclusion.
13. Refund Policy:
E-date Service will issue a refund within 72 hours of an initial subscription is case that none of the services have been provided to the customer. Beyond these conditions, requests for refunds will be at the discretion of E-date Service.
14. Miscellaneous
The present Agreement, acceptance of which is confirmed by you using AdorableWife.com , is the agreement between you and E-date Service regarding all issues, concerning the usage of AdorableWife.com and/or rendering of its services to you (except for the list of rendered services and costs). Even if some of the conditions of the present agreement are nullified, all other conditions will keep their force.
